Seller Overview

For your convenience, the following are some of the most important requirements for Sellers as detailed in the Terms of Service below. By using MJR Gallery, you ("Seller") agree, without limitation or qualification, to be bound by, and to comply with, the entire Terms of Service.

As a Seller, it is agreed:

you are age 18 or older;
you are the copyright owner or have the proper permissions for any content or images you upload;
as selling your own items you will promptly ship the correct item(s) upon accepting an order;
you agree with the Terms of Service in its entirety.

1. This website is owned and operated by MJR Gallery. These Terms set forth the terms and conditions under which you may use my website and services as offered by me. This website offers visitors products to sell or purchase. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

2. Key commercial Terms offered to customers

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

2.1 The purchase price shall be the price offered by MJR Gallery and confirmed to the Buyer by written invoice issued by MJR Gallery.

2.2 The purchase price includes the cost of packaging, delivery and VAT. Excise or similar duty may be applied in addition by the importing country.

2.3 All payment shall be made in British Pounds Sterling and the agreed price is due in full at the time the offered price is accepted. The currency converter is for indicative purposes only. Currency rates are provided by XE.

2.4 Availability of any particular artwork cannot be guaranteed and that ordering from MJR Gallery does not necessarily mean that the artwork is in stock. In this event the customer is entitled to a full refund within 2 weeks of the received payment.

2.5 Ownership (legal title) of the product will not pass to Buyer until the accepted and confirmed price is paid in full by the Buyer and received by MJR Gallery in cleared funds.

2.6 Late Fees. Any payment not paid in full as per the Terms and Conditions will be subject to interest assessed on funds due at 3 percent per annum over the Royal Bank of Scotland base rate from time to time.

3. Return and refund policy

3.1 Where a guarantee is offered on the product page, if you are unsatisfied with your purchase contact MJR Gallery at rooneymrkj@gmail within 7 days of the date you received the product.

3.2 The return requires that the artwork is sent back to the gallery or artist in perfect condition within 30 days of receiving the artwork; upon which you will receive a full refund. To process a return, please send an e-mail to rooneymrkj@gmail.com informing why you would like to return your order. Please note that all returns are organised and paid for by the receiver. Make sure the artwork is securely packaged for transport - it's recommend that you use the original packaging.

4. Changes to the Terms and Conditions
MJR Gallery reserves the right to change these terms at any time. Please check these terms each time you use the website; if you use the website after changes are posted, it means that you have accepted the terms as modified by the posted changes. Please refer to the Privacy Statement to find out how your personal information is used.

5. Accessing the site
While every effort is made to ensure that the website is available at all times, MJR Gallery shall not be liable if for any reason the website is unavailable for any period. Access to the website may be suspended without notice for reasons beyond control. MJR Gallery shall use reasonable endeavours to keep the site free from viruses and corrupt files but does not warrant that the site is free from infection by viruses or anything else with contaminating or destructive properties. I recommend that you ‘virus check’ all information received.

You must not introduce or attempt to introduce any virus or any other contaminant to the site nor in any way attempt to access or otherwise tamper with any part of the site. You agree to use this site only for lawful purposes and in a manner that complies with all applicable laws and regulations and does not infringe the rights of anyone else, nor restrict or inhibit their use and enjoyment of the site.

MJR Gallery reserves the right to suspend or terminate your access and use (in whole or in part) of the site at any time with or without notice. In so far as is able, MJR Gallery exclude all liability for all direct, indirect, punitive or consequential loss or damage which arises out of or in connection with the use of this website.

6. Accuracy of Content
While every effort is made to ensure the accuracy of information on this website, site content may not be accurate or complete. MJR Gallery can accept no responsibility for the uses to which site content is applied and you should use your own judgement in evaluating the accuracy, completeness or usefulness of any opinion, advice or other content on the site.

7. Intellectual Property

Except for any Art Submissions, the Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of MJR Gallery. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

This site contains links to external websites. Any external links are provided as a source of additional information on sponsors and relevant organisations. MJR Gallery is not responsible for the contents of external websites nor for the availability of linked pages. The presence of a link to an external website does not imply any endorsement by the organisation of that site, its owner, its content or any service that it provides. You must not link to this website www.mjrgallery.com for commercial purposes without my written agreement.

9. Services
In parts of the site you may be enabled to interact with other users or MJR Gallery, through (for example) booking forms, blogs and email. You must ensure that any such interaction by you or through your email address will not breach any applicable law or regulation or be perceived as inappropriate for the site, libellous, offensive or misleading. Obscenities, critical or derogatory comments will not be approved as content and any postings or other interaction may be removed at MJR Gallery's entire discretion.
